Summary of the terms and conditions:

  • Right of withdrawalYou can cancel your order within 14 days without giving any reason. This excludes perishable goods and services that have already been used.

  • Payment and shippingPayments are accepted via PayPal, credit card, instant bank transfer, and other common payment methods. Shipping costs are additional and vary depending on size and weight. Shipping to Switzerland may incur customs duties and additional charges.

  • Dispute resolutionIn the event of a dispute, you can use the EU's online dispute resolution platform. However, we are not obligated to participate in a dispute resolution procedure.

  • Liability and warrantyIf the products are defective, you can insist on a replacement. We are not liable for damages caused by improper use.

  • SubscriptionsSubscriptions renew automatically unless cancelled in time. You can cancel at any time.

§ 1 Scope

(1) The following General Terms and Conditions (GTC) apply to contracts concluded between Brewout Coffee Co and you as a buyer via the website www.brewout.de will be closed.
(2) Any differing, conflicting or supplementary terms and conditions of yours shall only become part of the contract if we expressly agree to their validity.

§ 2 contractual partners

The purchase agreement is concluded with the Lerch, Neß, Dincher GbR (Brewout Coffee Co).

§ 3 Formation of the contract

(1) Your order constitutes a binding offer. The contract is concluded when we confirm your order by email or dispatch the goods to you.
(2) The order confirmation is automatic as soon as you submit the order and does not constitute acceptance of the contract.
(3) We reserve the right to cancel or refuse orders if the goods are unavailable or due to an error in the order.

§ 4 Right of withdrawal and return

(1) Right of withdrawal:
You can cancel the contract within 14 days without giving any reason. The cancellation period is 14 days from the day on which you or a third party designated by you took possession of the last item.
Exceptions:

  • Perishable goodsThe right of withdrawal for perishable goods, such as coffee or food, is excluded.

  • ServicesServices (e.g., coffee courses) cannot be cancelled once they have begun.
    (2) Declaration of revocation:
    The cancellation can be made by a clear declaration (e.g. by email to info@brewout.de) take place.
    (3) Consequences of the revocation:
    We will refund the purchase price no later than 14 days after receiving your cancellation, however we will not cover the return shipping costs unless the goods were faulty or we have expressly agreed otherwise.
    (4) Packaging and returns:
    You are obliged to return the goods in unused condition and in the original packaging.

§ 5 Shipping and Delivery

(1) Shipping costs:
All prices include VAT. In addition to the prices shown, we charge shipping costs, which vary depending on weight and size. These will be displayed during the ordering process.
(2) Shipping to Switzerland:
Customers from Switzerland should be advised of any customs duties and clearance fees that may be incurred upon delivery or import. These are to be borne by the buyer.
(3) Delivery times:
We strive to ship your order as quickly as possible. Delivery typically takes 3-5 business days within Germany and up to 10 business days for international orders.

§ 6 Methods of payment

The following payment methods are available to you:

  • PayPal

  • credit card (Visa, MasterCard)

  • Instant bank transfer

  • The invoice (via Klarna)

  • SEPA direct debit

Payment is made immediately after completion of the order process.

§ 7 Dispute resolution

(1) The European Commission provides a platform for online dispute resolution (ODR platform). This can be accessed via the following link: https://ec.europa.eu/odr.
(2) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 8 Liability

(1) Disclaimer:
We are not liable for damages caused by improper handling or incorrect use of the products.
(2) Liability for product damage:
Our liability for product damage is governed by the statutory provisions.
(3) Liability for defects:
The statutory warranty provisions apply. Should a product have defects, you are entitled to subsequent performance, i.e., repair or replacement.

  • Statute of limitations for warranty claimsClaims for defects expire within 2 years from delivery of the goods.

§ 9 Subscription contracts

(1) Term and termination:
Subscription contracts are concluded for the durations specified in the respective offer.
(2) Automatic renewal:
The contract will automatically renew if it is not cancelled one month before the end of the initial term.
(3) Termination conditions:
You can cancel the contract at any time without giving reasons by sending us a corresponding message to info@brewout.de send.

§ 10 Data Protection

(1) Collection and processing of data:
Your personal data will be used exclusively for processing the order and for communication within the framework of the contract.
(2) Privacy Policy:

§ 11 Final Provisions

(1) Changes to the Terms and Conditions:
We reserve the right to change these terms and conditions at any time. Any changes will be displayed to you before your next purchase.
(2) Jurisdiction:
If you are a merchant, the place of jurisdiction is the registered office of Brewout Coffee Co, Bickenbach, Germany.
(3) Applicable law:
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
